These Terms of Use ("Terms") govern your access to and use of the EazyOut website (eazy-out.com) and any related tools, content, products, or services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. About EazyOut (No Legal Advice)

EazyOut provides digital tools, educational content, and guidance designed to help timeshare owners better understand their options and manage certain steps themselves.

EazyOut is not a law firm and does not provide legal, tax, or financial advice. No attorney-client relationship is created by using the Services. The information and materials provided are for informational and educational purposes only and are not a substitute for advice from a licensed attorney or other professional. You are solely responsible for your decisions and actions.

2. Eligibility

You may use the Services only if you:

  • Are at least 18 years old, and
  • Have the legal capacity to enter into a binding contract.

By using the Services, you represent and warrant that you meet these requirements.

3. Account Registration and Security

To access certain features, you may need to create an account and provide accurate, current information.

You agree to:

  • Maintain the confidentiality of your login credentials,
  • Be responsible for all activities that occur under your account,
  • Notify us promptly of any unauthorized use or security breach.

We reserve the right to suspend or terminate your account if we believe you have violated these Terms or engaged in fraudulent or abusive behavior.

4. Subscriptions, Payments, and Billing

Some parts of the Services may require payment, such as subscriptions, one-time purchases, or premium features.

  • Prices and features are described on the website and may change from time to time.
  • Payments are processed by third-party payment processors. We do not store full payment card numbers.
  • By providing payment information, you authorize us and our payment processor to charge the applicable fees.
  • If your subscription renews automatically, you authorize recurring charges until you cancel in accordance with our cancellation procedures.

5. User Responsibilities

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are responsible for:

We may suspend or terminate access to the Services if we believe you have violated this section.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE,
  • ANY INFORMATION PROVIDED THROUGH THE SERVICES IS COMPLETE, ACCURATE, OR SUITABLE FOR YOUR PARTICULAR SITUATION,
  • ANY SPECIFIC OUTCOME, RESULT, OR TIMESHARE EXIT WILL OCCUR.

YOU USE THE SERVICES AT YOUR OWN RISK. YOU SHOULD CONSULT WITH A LICENSED ATTORNEY OR OTHER PROFESSIONAL BEFORE MAKING LEGAL OR FINANCIAL DECISIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAZYOUT AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO EAZYOUT FOR THE SERVICES IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless EazyOut and its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services,
  • Your violation of these Terms,
  • Your violation of any rights of another person or entity.

12. Changes to the Services and Terms

We may modify or discontinue any part of the Services at any time, with or without notice.

We may also update these Terms from time to time. The "Last updated" date at the top indicates when the latest changes were made. Your continued use of the Services after the Terms are updated constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which EazyOut, LLC is organized, without regard to its conflict-of-law principles.
